"Service" — the BullAlert web application accessible at bullalert.ai, including all alerts, data, analysis, and features provided therein.

2. Acceptance of Terms

By accessing or using BullAlert ("the Service"), operated at bullalert.ai, you agree to be bound by these Terms of Service, the Investment Disclaimer, and the Privacy Policy, which are incorporated herein by reference. These Terms constitute a legally binding agreement between You and the Service Provider. By creating an account, You represent that You are at least 18 years of age and legally capable of entering into binding contracts. If you do not agree, do not use the Service.

3. Nature of the Service — Publisher's Exemption

BullAlert is a financial information publishing service. The Service Provider operates as a financial publisher under the publisher's exemption doctrine. All alerts, scores, tiers, and AI-generated analyses are:

Produced by automated algorithms
Distributed identically and simultaneously to all subscribers
Impersonal in nature and not tailored to any individual's financial circumstances
Provided for informational and educational purposes only

The Service does not constitute investment advice, and the Service Provider is not acting as an investment advisor, broker-dealer, or fiduciary.

4. Not Financial Advice

BullAlert is an informational tool. Nothing on this platform constitutes financial advice, investment recommendations, or a solicitation to buy or sell securities. We are not registered investment advisors, broker-dealers, or financial planners. All information is provided "as is" for educational purposes only.

Algorithmic Impersonality: The algorithmic, impersonal nature of the Service is a material term. You acknowledge that no human at BullAlert reviews, approves, or personalizes any alert before it is published to subscribers. The same data is sent to all subscribers simultaneously.

5. No Guarantees

Past performance of alerts, tiers, or scores does not guarantee future results. Stock trading involves substantial risk of loss, including the loss of your entire investment. 6. Data Accuracy & Latency

We source data from third-party providers including Reddit and financial data APIs. While we strive for accuracy, we make no warranty that the data is complete, accurate, or timely. Prices, scores, and analysis may be delayed by 15 minutes or more, or contain errors. You acknowledge that data latency is inherent in the Service and agree to verify all information through independent sources before making any trading decision.

7. User Responsibility

You agree to:

Conduct your own research and due diligence before any investment
Not rely solely on BullAlert for trading decisions
Not interpret any alert, tier ranking, or score as a recommendation to buy, sell, or hold any security
Use the Service in compliance with applicable laws
Not redistribute, scrape, or resell data from the Service
Not use automated tools or bots to access the Service beyond normal browser usage

8. Subscription & Billing

BullAlert offers a monthly subscription at $99/month with a 7-day free trial. Your payment method will be charged automatically at the end of the trial period unless you cancel. Cancellation must occur before the trial ends to avoid charges.

Your subscription renews automatically each month until canceled
Cancellation takes effect at the end of the current billing period — you retain access until then
If you are unsatisfied, you may request a full refund within 14 days of your first charge
No refunds are provided for partial months after the 14-day refund window
All payment processing is handled securely by Stripe — we never store your card details

9. EU Digital Content — Right of Withdrawal

Under EU Directive 2011/83/EU and the Polish Consumer Rights Act (Ustawa o prawach konsumenta), You have a statutory right to withdraw from a distance contract within 14 days. However, in accordance with Article 38(13) of the Consumer Rights Act, by activating Your subscription and accessing the Service (including the free trial), You expressly consent to the immediate provision of digital content before the withdrawal period has expired, and You acknowledge that by doing so, You waive Your right of withdrawal.

This waiver is obtained through explicit consent at the point of subscription activation. The 7-day free trial allows You to evaluate the Service before any charge is made.

10. Account Termination

The Service Provider reserves the right to suspend or terminate Your account, with or without notice, for any of the following reasons:

Violation of these Terms
Abnormal usage patterns including but not limited to automated scraping, data harvesting, systematic downloading, or redistribution of Service content
Reselling, sublicensing, or commercially exploiting Service data
Using the Service to manipulate markets or engage in activities prohibited by securities laws
Non-payment or payment disputes

Upon termination for cause, no refund shall be due.

11. Intellectual Property

All content, algorithms, scoring methodologies, tier rankings, AI models, interface designs, and data compilations on the platform are the intellectual property of the Service Provider. You are granted a limited, non-exclusive, non-transferable, revocable license to access the Service for personal, non-commercial use. You may not: copy, reproduce, redistribute, scrape, reverse-engineer, or create derivative works from the Service or its content.

12. Indemnification

You agree to indemnify, defend, and hold harmless the Service Provider and its affiliates, officers, agents, and licensors from and against any claims, damages, obligations, losses, liabilities, costs, or expenses (including reasonable attorney's fees) arising from:

Your use of the Service
Your trading decisions
Your violation of these Terms
Your violation of any applicable law or regulation
Any claim that Your use of the Service caused harm to a third party

13. Limitation of Liability

To the maximum extent permitted by applicable law, the total aggregate liability of BullAlert and its operator for any claims arising out of or relating to the Service shall not exceed the lesser of: (a) the total amount You have paid to BullAlert in the twelve (12) months immediately preceding the claim, or (b) one hundred United States dollars (USD $100).

In no event shall BullAlert be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to damages for loss of profits, trading losses, goodwill, data, or other intangible losses.

14. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO: MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR AVAILABILITY. The Service Provider does not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or harmful components.

15. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Republic of Poland. Any disputes arising out of or in connection with these Terms shall be submitted to the exclusive jurisdiction of the courts competent for the Service Provider's registered business address.

For EU consumers: this clause does not deprive You of the protection afforded by mandatory provisions of the law of the EU Member State in which You reside.

16. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision shall be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions shall continue in full force and effect.

17. Changes to Terms

We reserve the right to update these Terms at any time. Material changes will be communicated via email at least 14 days before taking effect. Continued use of the Service after the effective date constitutes acceptance. If You do not agree to the updated Terms, You must discontinue use of the Service before the effective date.
