Terms of Service

1. Definitions

• "Service" — the BullAlert web application accessible at bullalert.ai, including all alerts, data, analysis, and features provided therein.
• "Service Provider," "We," "Us," "Our" — Adrian Bigaj, Firma informatyczna BigsonDev Adrian Bigaj, conducting business under the name BullAlert, a sole proprietorship (Jednoosobowa Działalność Gospodarcza) registered in Poland, with registered address at Karmelicka 5/5, 31-133 Kraków, Małopolskie, NIP: 9452234988, REGON: 385858724.
• "User," "You," "Your" — any individual who accesses or uses the Service.
• "Content" — all alerts, tier classifications, proprietary momentum scores, AI-generated analysis, derived signal badges, pattern classifications, and other algorithmic outputs available through the Service.
• "Subscription" — the paid access plan for the Service, available in weekly ($29/week), monthly ($69/month), and yearly ($399/year) tiers, with a 3-day free trial on the monthly plan.

2. Acceptance of Terms

By accessing or using BullAlert ("the Service"), operated at bullalert.ai, you agree to be bound by these Terms of Service, the Investment Disclaimer, and the Privacy Policy, which are incorporated herein by reference. These Terms constitute a legally binding agreement between You and the Service Provider. By creating an account, You represent that You are at least 18 years of age and legally capable of entering into binding contracts. If you do not agree, do not use the Service.

3. Nature of the Service — Information & Data Tool / Publisher's Exemption

BullAlert is an information and data tool operated as a financial information publishing service. Every alert, tier grade, momentum score, volume context badge, percentage change, pattern classification, AI-generated analysis, and other output of the Service is provided for informational and educational purposes only. The Service Provider operates as a publisher under the publisher's exemption doctrine. All Content is:

• Produced by automated algorithms
• Distributed identically and simultaneously to all subscribers
• Impersonal in nature and not tailored to any individual's financial circumstances
• Provided for informational and educational purposes only

The Service does not constitute investment advice, and the Service Provider is not acting as an investment advisor, broker-dealer, or fiduciary.

3A. Third-Party Integrations & Partner Platforms

BullAlert is a publication and information service only. We do not execute trades, hold subscriber funds, route orders, or operate a brokerage. Everything we produce is derived intelligence — rankings, scores, tier and catalyst classifications, and historical observations — never a market-data feed and never an order instruction.

Subscriber-initiated integrations. You may choose to connect BullAlert outputs to third-party tools, brokers, or automated-execution platforms that you separately engage. Any such platform is an independent counterparty to you; you use it under your own due diligence and at your own risk.

Partner platforms (B2B). BullAlert may also make its derived outputs available to third-party platforms — including data, analytics, brokerage, and automated-trading or execution platforms — under separate written commercial agreements. Any such partner receives only BullAlert's derived intellectual property (signals, scores, rankings, classifications); it never receives raw, real-time, or delayed market data from us, and it is solely responsible for sourcing and licensing any market data, brokerage, or execution capability it uses and for its own regulatory compliance. BullAlert is not a broker-dealer, is not a party to any order or trade that a partner or its users place, and operates only as the upstream intelligence layer.

In all cases, BullAlert is not responsible for: (i) trade execution, order routing, fill quality, or slippage on any third-party platform; (ii) the operation, uptime, solvency, or conduct of any third-party platform; or (iii) losses arising from a decision to use any such platform.

4. Not Financial Advice

BullAlert is an information and data tool. Nothing on this platform constitutes financial advice, investment advice, trading advice, investment recommendations, or a solicitation to buy, sell, or hold any security. No alert, tier grade, momentum score, volume context badge, percentage change, pattern classification, AI-generated summary, or other output of the Service is a "buy," "sell," or "hold" recommendation. We are not registered investment advisors, broker-dealers, financial planners, or fiduciaries. All Content is provided "as is" for informational and educational purposes only.

Algorithmic Impersonality: The algorithmic, impersonal nature of the Service is a material term. You acknowledge that no human at BullAlert reviews, approves, or personalizes any alert before it is published to subscribers. The same data is sent to all subscribers simultaneously.

5. No Guarantees

Past performance of alerts, tiers, or scores does not guarantee future results. Stock trading involves substantial risk of loss, including the loss of your entire investment. You are solely responsible for your own trading decisions. For full details on hypothetical performance limitations, see our Investment Disclaimer.

6. Data Accuracy & Latency

The Service's derived signals are produced by our proprietary algorithm from market data, news, regulatory filings (including SEC EDGAR), and social signals. While we strive for accuracy, we make no warranty that the underlying data is complete, accurate, or timely. Outputs may contain errors. You acknowledge that data latency is inherent in the Service and agree to verify all information through independent sources before making any trading decision.

Derived analytics only — not a market-data feed. The derived signals, scores, percentages, and other metrics displayed on the platform are BullAlert's own outputs — they are not an exchange data feed and must not be relied upon as one. For current stock prices and market data You must consult Your broker or a licensed market-data provider. How we license and use the underlying data is set out in the Data Sources and No-Redistribution sections below.

We may change underlying data sources at our discretion provided continuity of the Service is maintained.

7. Data Sources & Attribution

BullAlert is an alternative data intelligence layer. We source market data, news, regulatory filings (including SEC EDGAR), and social momentum signals from licensed third-party infrastructure providers under a commercial internal-use license, for internal computation only. BullAlert publishes only its own proprietary derived signals, classifications, and scores — never raw market data (see the No-Redistribution covenant below).

All visible indicators — including tier grades (S/A/B/C/D), volume context badges (vs 10-day baseline), signal badges, float classifications, market cap labels, short interest badges, momentum scores, and pattern classifications — are BullAlert's proprietary algorithmic outputs.

For current stock prices and market data, users should consult their broker or external services such as TradingView.

8. No Market Data Redistribution — Licensed for Internal Use, No Re-Exposure

The market data BullAlert uses is accessed under a commercial internal-use license and is never redistributed. The raw data feeds our pattern identification internally and is never re-exposed to subscribers as a market-data feed.

Licensed market data is used solely for internal pattern identification. It feeds our proprietary scoring algorithm and our data intelligence layer — nothing else. The Service does not re-expose, redistribute, resell, sublicense, display, republish, or relay raw market data, quotes, order book information, trading volumes, bars, or any exchange-derived numerical data from any third-party data source. The raw inputs are consumed internally to produce our derived intellectual property and never leave the processing layer. Our outputs cannot be reverse-engineered into the underlying data feed and are not a substitute for it.

Subscribers receive only BullAlert's IP-derived categorical outputs (tier badges, score, catalyst, AI rating) and derived observations (catch→peak %) — computed by our proprietary algorithm, never a raw market-data feed.

9. User Responsibility

You agree to:

• Conduct your own research and due diligence before any investment
• Not rely solely on BullAlert for trading decisions
• Not interpret any alert, tier ranking, or score as a recommendation to buy, sell, or hold any security
• Use the Service in compliance with applicable laws
• Not redistribute, scrape, or resell data from the Service
• Not use automated tools or bots to access the Service beyond normal browser usage

10. Subscription & Billing

BullAlert offers multiple subscription plans: Weekly ($29/week), Monthly ($69/month), and Yearly ($399/year). A 3-day free trial is available on the monthly plan only. No trial is offered on the weekly, yearly, or lifetime plans. Your payment method will be charged automatically at the end of the trial period unless you cancel. Cancellation must occur before the trial ends to avoid charges.

• All plans auto-renew until canceled. Cancel anytime from your billing dashboard
• Cancellation takes effect at the end of the current billing period — you retain access until then
• Monthly plan: 14-day refund window from date of first charge
• Weekly plan: 7-day refund window from date of first charge
• Yearly plan: 14-day refund window from date of first charge
• Lifetime plan: 14-day refund window from date of purchase
• No refunds are provided for partial billing periods after the applicable refund window
• All payment processing is handled securely by Stripe — we never store your card details

11. EU Digital Content — Right of Withdrawal

Under EU Directive 2011/83/EU and the Polish Consumer Rights Act (Ustawa o prawach konsumenta), You have a statutory right to withdraw from a distance contract within 14 days. However, in accordance with Article 38(13) of the Consumer Rights Act, by activating Your subscription and accessing the Service (including the free trial), You expressly consent to the immediate provision of digital content before the withdrawal period has expired, and You acknowledge that by doing so, You waive Your right of withdrawal.

This waiver is obtained through explicit consent at the point of subscription activation. The 3-day free trial allows You to evaluate the Service before any charge is made.

12. Account Termination

The Service Provider reserves the right to suspend or terminate Your account, with or without notice, for any of the following reasons:

• Violation of these Terms
• Abnormal usage patterns including but not limited to automated scraping, data harvesting, systematic downloading, or redistribution of Service content
• Reselling, sublicensing, or commercially exploiting Service data
• Using the Service to manipulate markets or engage in activities prohibited by securities laws
• Non-payment or payment disputes

Upon termination for cause, no refund shall be due.

13. Intellectual Property

All content, algorithms, scoring methodologies, tier rankings, AI models, interface designs, and data compilations on the platform are the intellectual property of the Service Provider. You are granted a limited, non-exclusive, non-transferable, revocable license to access the Service for personal, non-commercial use. You may not: copy, reproduce, redistribute, scrape, reverse-engineer, or create derivative works from the Service or its content.

This personal-use license governs individual subscribers only. Commercial use, redistribution of our derived outputs, programmatic API access beyond a subscriber's own use, and integration into a third-party product or platform are available exclusively under a separate written agreement with the Service Provider, and nothing in this Section restricts the Service Provider from entering into such agreements. 14. Indemnification

You agree to indemnify, defend, and hold harmless the Service Provider and its affiliates, officers, agents, and licensors from and against any claims, damages, obligations, losses, liabilities, costs, or expenses (including reasonable attorney's fees) arising from:

• Your use of the Service
• Your trading decisions
• Your violation of these Terms
• Your violation of any applicable law or regulation
• Any claim that Your use of the Service caused harm to a third party

15. Limitation of Liability

To the maximum extent permitted by applicable law, the total aggregate liability of BullAlert and its operator for any claims arising out of or relating to the Service shall not exceed the lesser of: (a) the total amount You have paid to BullAlert in the twelve (12) months immediately preceding the claim, or (b) one hundred United States dollars (USD $100).

In no event shall BullAlert be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to damages for loss of profits, trading losses, goodwill, data, or other intangible losses.

16. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO: MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR AVAILABILITY. The Service Provider does not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or harmful components.

17. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Republic of Poland. Any disputes arising out of or in connection with these Terms shall be submitted to the exclusive jurisdiction of the courts competent for the Service Provider's registered business address.

For EU consumers: this clause does not deprive You of the protection afforded by mandatory provisions of the law of the EU Member State in which You reside.

18. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision shall be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions shall continue in full force and effect.

19. Changes to Terms

We reserve the right to update these Terms at any time. Material changes will be communicated via email at least 14 days before taking effect. Continued use of the Service after the effective date constitutes acceptance. If You do not agree to the updated Terms, You must discontinue use of the Service before the effective date.
