BullAlert is an information and data tool operated as a publisher of impersonal, general analysis under the publisher's exemption doctrine. Every output is generated by an automated algorithm and distributed identically and simultaneously to every subscriber — impersonal, not tailored, and never directed at any individual's financial circumstances. Market data we use is licensed for internal processing only and never redistributed; the raw data feeds our pattern identification internally, and subscribers see only our IP-derived outputs (tier badges, scores, catalysts, AI ratings) and derived observations (catch→peak %). For prices, we link out to your broker or charting platform. Nothing on the Service is investment advice, a recommendation, or a solicitation to buy, sell, or hold any security.

1. Publisher's Exemption & Algorithmic Impersonality

BullAlert is a publisher of impersonal, algorithmic analysis. All content, alerts, tiers, scores, and AI-generated analysis are produced by automated algorithms and distributed identically and simultaneously to all subscribers without regard to any individual's financial situation, investment objectives, or risk tolerance. No content is tailored, customized, or directed at any specific individual. This impersonal, algorithmic nature is fundamental to the Service and constitutes the basis on which it is offered. The Service Provider does not know, and has no obligation to know, whether any individual subscriber acts upon the information provided.
Every subscriber receives the same outputs at the same time. Our scoring is algorithmic, impersonal, and identical across the subscriber base. We do not personalize signals to any individual subscriber, account size, financial situation, or risk profile. BullAlert does not provide investment advice; outputs are informational and educational only, and nothing we publish is a recommendation to buy, sell, or hold any security.
2. Not a Broker-Dealer
BullAlert does not execute, facilitate, or recommend securities transactions. We do not hold client funds, securities, or accounts. We do not receive commissions or transaction-based compensation. We do not provide order routing or trade execution services. If you choose to trade any security mentioned on the platform, you do so through your own brokerage account, at your own discretion and sole risk.
3. No Investment Recommendations — Information & Data Tool Only
BullAlert does not recommend that any stock, security, or other financial instrument should be bought, sold, or held by you. No alert, tier ranking, momentum score, AI analysis, pattern label, volume context badge, percentage change, or other output of the Service constitutes a "buy," "sell," or "hold" recommendation. The presence of a stock on the platform, at any tier level, does not imply endorsement or recommendation. All alerts, tiers, scores, AI analyses and metrics provided are outputs of an automated information and data tool, derived from historical market data, news, regulatory filings, and publicly available social signals, and are made available to all subscribers identically and simultaneously without regard to any individual's circumstances. They are informational only. We surface what's moving; you decide.
Setups described as "swing" or "multi-day" patterns are observations of historical price behavior matching certain criteria — they are NOT forecasts of future movement, recommendations to take any position, or representations that any future setup will behave similarly.
When we display "catch%" and "peak%" figures, these are historical observations: "catch" is the price at the moment our algorithm identified a setup in the historical record; "peak" is the highest subsequent price reached within a defined historical window. They are descriptive, not predictive.

Any performance data displayed on the platform, including but not limited to "Yesterday's Winners," historical win rates, tier performance statistics, and daily summaries, represents HYPOTHETICAL and/or HISTORICAL performance results.
HYPOTHETICAL PERFORMANCE RESULTS HAVE MANY INHERENT LIMITATIONS. NO REPRESENTATION IS BEING MADE THAT ANY ACCOUNT WILL OR IS LIKELY TO ACHIEVE PROFITS OR LOSSES SIMILAR TO THOSE SHOWN. IN FACT, THERE ARE FREQUENTLY SHARP DIFFERENCES BETWEEN HYPOTHETICAL PERFORMANCE RESULTS AND THE ACTUAL RESULTS SUBSEQUENTLY ACHIEVED.
Hypothetical results do not account for:
- Commissions, fees, or slippage

5. Extended Hours Trading Volatility
BullAlert operates from 8:00 AM to 5:00 PM Eastern Time, covering pre-market (8:00 AM – 9:30 AM ET), regular trading hours (9:30 AM – 4:00 PM ET), and after-hours (4:00 PM – 5:00 PM ET). Extended hours trading carries substantially elevated risk including but not limited to:
- Wider bid-ask spreads
- Significantly lower liquidity and higher volatility
- Greater price uncertainty
- Delayed or limited order execution
- Prices that may not reflect the opening or closing price during regular hours
Alerts generated during pre-market or after-hours sessions should be considered with additional caution. BullAlert is not responsible for trade execution or slippage during any trading session.
6. Data Sources — Licensed for Internal Use, No Redistribution

BullAlert's intelligence layer is built on market data accessed under a commercial internal-use license, together with news feeds, SEC EDGAR filings, and social momentum signals. We use this market data solely to compute our own analytics within our systems — it is processed internally, and the raw market data is never displayed, shared, redistributed, republished, or relayed to subscribers, partners, or the public as a market-data feed. We may change our underlying data providers at any time without notice.
Everything we publish is our own derived intellectual property — momentum scores, tier grades, categorical volume bands (a 10-trading-day baseline, never a raw multiple), pattern labels, and historical catch→peak observations. These outputs are not the underlying market data, cannot be reverse-engineered back into it, and are not a substitute for a licensed market-data feed. For current stock prices and charts, consult TradingView or your broker.

7. Data Accuracy & Latency
Underlying data sourced from third-party providers undergoes internal processing. News and social signals introduce additional latency. AI-generated analysis may contain errors, hallucinations, or outdated information. We make no warranty regarding the accuracy, completeness, timeliness, or reliability of any derived signals presented. The derived signals, scores, and percentages displayed on the platform are not a real-time exchange data feed and must not be relied upon as one. You should always verify information through independent sources, your broker, or a licensed real-time market-data provider before making any trading decision.
8. Risk of Loss
Trading stocks and other securities involves substantial risk of loss, including the potential loss of your entire investment. You should only trade with money you can afford to lose. Momentum stocks, penny stocks, small-cap equities, and OTC securities are particularly volatile and carry higher risk including lower liquidity and less regulatory oversight. If you trade on margin, you may lose more than your initial investment.
9. US Market Focus
BullAlert scans for US-traded stocks (including NYSE, NASDAQ, AMEX, and OTC securities) with a focus on penny stocks and small-cap securities. The information provided may not be applicable to other markets or jurisdictions. OTC and penny stocks carry additional risk including lower liquidity and less regulatory oversight. Users outside the United States should consult with local financial advisors regarding applicable regulations.

Machine learning models may exhibit biases based on training data. No algorithm can predict future stock price movements with certainty. Algorithm updates may change the nature, frequency, or quality of alerts without notice.
12. No Tax, Legal, or Regulatory Advice
Nothing on this platform constitutes tax advice, legal advice, or regulatory guidance. Tax treatment of securities transactions varies by jurisdiction and individual circumstance. Consult qualified professionals in your jurisdiction for tax, legal, and regulatory matters.
13. Limitation of Liability
To the maximum extent permitted by applicable law, the total aggregate liability of BullAlert, its operator, employees, affiliates, and agents for any claims arising out of or relating to the Service shall not exceed the lesser of: (a) the total amount you have paid to BullAlert in the twelve (12) months immediately preceding the claim, or (b) one hundred United States dollars (USD $100).
In no event shall BullAlert be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to damages for loss of profits, trading losses, goodwill, data, or other intangible losses, regardless of whether BullAlert has been advised of the possibility of such damages.
14. Governing Documents
This Disclaimer is incorporated into and forms part of the Terms of Service. By using the Service, You agree to be bound by both this Disclaimer and the Terms of Service.
